1) Case-I: Mr X., Auditor on 01-01-06, drawing Basic Pay Rs. 4875/- in Pay Scale(Old Pay Scale 4500-125-7000) gets his promotion of Sr. Auditor on 03-04-2006 in the Pay Scale(Old Pay) 5500-175-9000.
Again on passing SAS examination he is promoted to SO(A) on 28-12-2007 in the Pay Scale of 6500-200-10500.
Case II: Mr. Y, Auditor on 01-01-06 drawing Basic Pay 4750/- in Pay Scale(Old Pay Scale 4500-125-7000) gets his promotion of SO(A) on 28-12-2007 in the Pay Scale(Old Pay) 6500-200-10500.
Injustice:
Mr X drwaing more pay than Mr Y in old pay Scales(No question about this). According to 6th CPC, Mr X will have option to get his pay fixed either from 01-01-06 or 03-04-06. Suppose he opts for best option(not Better but best) to fix his pay from 03-04-2006. His Fixation will be as under:
BP on 03-04-2006: 5500
Pay in PB (New Scale): 5500 x 1.86=10230
Grade Pay ( Sr. Aud)=4200
New Basic Pay as on 03-04-2006=10230+4200=14430.
Inc on 01-07-2007=14430 x 3%=440( Rounded to multiple of 10)
New Pay on 01-07-2007=14430+440=14870
On promtion on 28-12-07
Inc on this date=14870 x 3%=450( Rounded to multiple of 10)
Pay in Pay Band on Promotion=14870+450-4200=11120
Grade Pay ( SO(A))=4800
New Basic Pay on Promotion=11120+4800=15920.
Now Pay fixation of Mr Y on 28-12-2007.(Mr Y has freedom to get his pay fixed from 28-12-2007, because fortunately he has not got the oppurtunity to Promoted to Sr. Auditor)
Basic Pay on 28-12-2007(Old Pay): 6500
Pay in Pay Band on 28-12-2007 (in New Pay)=6500 x 1.86=12090
Grade Pay (SO(A))=4800
His New Pay on 28-12-2007=12090+4800=16890.
HERE IS THE INJUSTICE, A PERSON GEETING MORE PAY IN THE OLD SCALE NOW GETTING LESS PAY IN NEW PAY SCALE ONLY BECAUSE UNFORTUNATELY HE JOINED DEPARTMENT EARLIER THAN MR Y AND GOT THE PROMOTION AS SR AUDITOR.
